Please read these Terms of Service ("Terms") carefully before placing an order or using any services provided by PDFCatalogue ("we", "us", "our") at https://pdfcatalogue.com. By engaging our services you agree to be bound by these Terms.
1. Services
PDFCatalogue provides professional graphic design services including but not limited to: PDF product catalog design, price list design, lookbook design, line sheet design, digital brochure design, and interactive PDF creation. All services are delivered digitally as PDF files (and source files where included in the selected plan).
2. Orders and Payments
- All orders require a written confirmation (email is sufficient) from the client before work begins.
- A non-refundable deposit of 50% of the agreed project fee is required before we commence design work.
- The remaining balance is due upon delivery of the final approved files.
- Prices are quoted in US Dollars (USD) unless otherwise agreed in writing.
- We reserve the right to revise pricing for additional pages, services, or scope changes not included in the original quote.
3. Revisions
- The Basic plan includes up to 3 rounds of revisions. Standard and Premium plans include unlimited revisions until the client is satisfied.
- A "revision round" means one consolidated set of feedback submitted at one time.
- Revisions are limited to the original project scope. Changes to the scope (e.g., adding pages, changing the format, or redesigning approved sections) may incur additional charges.
- Revisions requested after the client has formally approved the final files are treated as a new project and will be quoted separately.
4. Client Responsibilities
You agree to:
- Provide accurate, complete, and timely content (text, images, brand assets) needed to complete the project.
- Ensure you have the right to use all images and content you provide to us.
- Respond to designer feedback and draft reviews in a timely manner. Delays in client response may push back the delivery timeline.
- Provide consolidated feedback per revision round (not piecemeal feedback sent across multiple messages).
5. Intellectual Property
- Upon receipt of final payment in full, you receive full ownership of the final delivered PDF files.
- Source files (InDesign/Illustrator) are included in Standard and Premium plans and transfer to you upon full payment.
- We retain the right to display the completed project in our portfolio and for marketing purposes, unless you request in writing that we do not.
- We retain ownership of any unused design concepts, drafts, and working files not included in the final deliverable.
- You warrant that any content, images, and materials you provide do not infringe any third-party intellectual property rights.
6. Delivery and Deadlines
- Estimated delivery times are provided in good faith and begin once we have received all required client content and the deposit payment.
- Delivery timelines may be affected by delays in receiving client content, feedback, or revision approvals.
- Rush delivery options are available on Premium plan projects at an additional fee. Rush orders must be agreed and confirmed before project commencement.
- We are not liable for delivery delays caused by circumstances outside our control.
7. Cancellations and Refunds
- The 50% deposit is non-refundable once design work has commenced.
- If you cancel a project after work has begun, you are responsible for payment of work completed up to the point of cancellation.
- If we are unable to complete your project for reasons solely within our control, a full or partial refund will be discussed in good faith.
- Refunds are not available for completed and approved projects.
8. Confidentiality
We treat all client content, business information, and project details as confidential. We will not share your files, product information, or business data with any third party except as required to deliver the service (e.g., a secure file transfer service) or as required by law.
9. Limitation of Liability
To the maximum extent permitted by law, PDFCatalogue shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or any errors in the delivered files. Our total liability for any claim arising from a project shall not exceed the total fees paid by you for that project.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, USA. Any disputes shall be subject to the exclusive jurisdiction of the courts of New York.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Continued use of our services following notification of changes constitutes your acceptance of the updated Terms. The version applicable to your project is the version in effect at the time your order is confirmed.
